Probate

A compassionate legal service, when you need it the most.

Dealing with the death of a loved one, whether a relative or a friend, can be a difficult and emotional time.

You may understandably be feeling quite overwhelmed by the formalities of the administration of the estate, or you may simply lack the time to deal with the estate. Milne Moser Solicitors can help you as much, or as little, as you need.

Our private client team combine a compassionate approach, legal expertise and experience to ensure the timely and smooth running of an estate from start to finish.

Milne Moser Solicitors can:

  • Help you to apply for the Grant of Probate (if the deceased has made a Will), or the Letters of Administration (if they did not make a Will).
  • Calculate the amount of inheritance tax due on the estate and organise any payment to HMRC for you.

Milne Moser can also:

  • Manage the entire estate administration process, including calculation of the value of the estate assets, application for the Grant, gathering in of assets, paying of liabilities and making distributions to the beneficiaries.
  • Provide advice on the option of varying a Will, and drafting the Deed of Variation, if required.

If someone you know has sadly died and you would like help dealing with their estate, please do get in touch – we are here to help.

The whole process involved in dealing with an estate can be simplified, as follows:

Step One.

The first step when dealing with a person’s estate is to collect financial information, so that a general picture can be pieced together.

This is done by creating a ‘snapshot’ of all of their assets and liabilities as at the date of their death. The estate can then be valued and the next step considered.

Step Two.

If a grant of probate or letters of administration are required, an inheritance tax return will need to be completed. An oath of representation will also need to be prepared before being sworn in front of a solicitor. If an inheritance tax liability arises, this will need to be paid.

An application can then be made to the High Court.

Step Three.

Once a grant of probate or letters of administration have been issued by the Court, the estate assets can be collected in and any property sold.

Any outstanding debts can then be paid and the balance of the estate distributed in accordance with the terms of the will; or, where there is no will, in accordance with the statutory intestacy rules.
